>>>The Henry Driessen Public Beach-Access Right-of-Way<<< – is a “PUBLIC” Pedestrian access-gate leading to/from the neighborhood park (a dedicated public access-easement). This vital connection from Bradley Circle to Driessen Beach Park (which provided direct beach-access for over !!+32!! years) ; has been BLOCKED by the Town of Hilton Head.
A legal Complaint has been filed requesting injunctive relief. However, until the public beach park access is restored, residents and guests cannot simply visit our neighborhood park OR enjoy the park’s safe/well-maintained beach-access boardwalk. This beach park access provides the only legal means of direct ‘beach-access’ for the large majority of properties on Bradley Circle.
There is no history of any crime associated with the beach park access; yet Bradley Circle residents and guests are being barricaded from the park – even during the DAYTIME!!! Meanwhile, all area parks (including Chaplin Park & Driessen Beach Park – just on the other side of the fence) continue to be open and free of any restrictions to surrounding homes. Only Bradley Circle is being isolated from this historic beach park; 24/7!!!:
- Bradley Beach Road residents and guests continue to have access to and from Driessen Beach Park;
- Seaside Subdivision, Singleton By The Beach & Singleton Shore Manor residents and guests continue to have access to and from Chaplin Park;
- Singleton Place residents and guests continue to have direct access to and from the beach and park from Collier Road (public access location).
This erroneous action by the Town has damaged the rights of property owners, residents and guests. It has also damaged the freedom of movement of the entire community by blocking an important walking and biking pathway/beach park connection. This obstruction violates the terms, intent and spirit of the Town’s own legal agreement:
“The Access Easement is for the purpose of providing pedestrian access to the Beach Park…for residents of the Bradley Circle area”; AND “is essentially necessary for the use and enjoyment of the Beach Park”.
“The Access Easement is for the use and benefit of the general public”
